BB84 Wallet — Terms of Service

These Terms of Service ("Terms") govern your use of the BB84 Wallet application, bb84.com, and the BB84 L2 network's public services (together, the "Service"), operated by Hadamard Corporation, 8206 Louisiana Blvd NE, Ste A #2316, Albuquerque, New Mexico 87113, USA, acting through its German branch, c/o Matteo Ludwig, Rudolf-Hahn-Straße 67A, 53225 Bonn, Germany ("Hadamard", "we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent that you are not located in, ordinarily resident in, or a national of any country or territory subject to comprehensive sanctions under United States, European Union, or United Nations law, and that you are not listed on any applicable government sanctions or denied-party list (including the U.S. OFAC Specially Designated Nationals list). You may not use the Service to evade any such sanctions.

2. Nature of the Service

BB84 Wallet is a non-custodial wallet. Your private keys are generated and stored on your own device; Hadamard never has access to them and cannot access, freeze, recover, or reverse your funds or transactions. You are solely responsible for safeguarding your device, your wallet backup, and any transaction you authorize.

The BB84 L2 network is an experimental, independently operated rollup. Hadamard operates supporting infrastructure (RPC endpoints, block explorer, ENS gateway, faucet, and related services) on a best-effort basis, without guaranteed uptime, and may modify, suspend, or discontinue any part of it at any time.

3. Send-to-Email Claim Links ("Send to Anyone")

The Service lets you send funds to a recipient's email address without them needing a pre-existing wallet. When you use this feature:

• Your app generates a one-time address and its secret key material entirely on your device, and funds it on-chain before we are involved.
• We email a link containing that secret to the recipient. Whoever redeems that link first receives the funds — the link functions like a bearer instrument (comparable to a cash note or a bearer cheque). Forwarding the email forwards the money. We cannot verify that the intended recipient is the one who claims it.
• You choose an expiry date when sending. Reaching that date does not cryptographically invalidate the claim address — it only changes how the status is displayed to you, and is the point after which you may attempt to reclaim the funds yourself. The recipient may still be able to claim the funds after the displayed expiry if you have not already reclaimed them. Whichever transaction is confirmed on-chain first — a claim or a reclaim — wins; there is no arbitration.
• We do not hold, custody, insure, or guarantee these funds at any point, and we cannot reverse a claim once it is broadcast to the network.

4. Third-Party Services

The Service integrates or links to independent third-party services that are not operated by Hadamard and are governed by their own terms:

• MoonPay (fiat on-ramp): purchases of crypto with card or bank transfer are performed entirely by MoonPay under its own terms, KYC/AML program, and regulatory licenses. Hadamard is not a party to that purchase and assumes no liability for it.
• Resend: used solely to deliver claim-link and notification emails.
• WalletConnect: used to connect to third-party decentralized applications, which are independent of Hadamard and used at your own risk.
• hadamard.eth ENS subdomains: provided as a convenience naming layer; resolution depends on our gateway remaining operational and is provided without uptime guarantees.

5. Prohibited Use

You may not use the Service for any unlawful purpose, including money laundering, terrorist financing, fraud, or to transact with sanctioned persons, entities, or jurisdictions. We may restrict access to the Service where required by applicable law.

6. No Financial Advice; No Warranty

Nothing in the Service constitutes financial, investment, tax, or legal advice. Digital assets are volatile and may lose value entirely. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Hadamard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of funds, data, or profits, arising from your use of the Service, including losses resulting from smart contract bugs, network outages, third-party services, or user error (such as sending a claim link to the wrong address or losing a device backup). Nothing in these Terms limits liability that cannot be limited under mandatory consumer-protection law applicable to you.

8. Intellectual Property

The BB84 protocol client and wallet app source code are published on GitHub under their own license terms. All other Service content, branding, and documentation are © 2026 Hadamard Corporation unless otherwise noted.

9. Governing Law and Venue

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles, and without prejudice to any mandatory consumer-protection provisions of the law of the country in which you are habitually resident. Courts of Bonn, Germany shall have non-exclusive jurisdiction, without prejudice to your right to bring proceedings in your own country of residence where mandatory law so provides.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.
